Allstate Denied My
Roof Claim: What Illinois
Homeowners Can Do Next
A denial letter is Allstate's position on one inspection. Here's what Illinois requires it to tell you, what the policy wording says, and which step fits the reason on your letter.
Free Storm Damage Roof Inspection
We dispatch a Haag-certified inspector to your address, same day in most cases.

"Donte Dacres provided outstanding service. He made the call to my insurance company with TOTAL professionalism."
Judith W."I was very worried about storm chaser roofers. Matt was patient and explained the whole process. He worked with me and my insurance company throughout."
Ram P."My insurance company said they would not cover my whole roof. C&N demanded a second insurance appraisal and BINGO! My re-roof was approved."
Michael G."Damian was incredibly helpful, especially with navigating insurance and the appraisal. The crew was efficient and got the job done quickly."
Alicja S.A denial letter is Allstate's position, not the last word. Illinois rules require Allstate to explain a denial in writing, cite the policy provision it relied on, and mention the Department of Insurance. Match that stated reason to the right step: better evidence, appraisal if only the amount is disputed, or a Department of Insurance complaint.

What Illinois Requires in a Denial Letter
When a company denies a first-party claim, or settles for less than you claimed, Illinois requires a reasonable written explanation within 30 days after it finishes its investigation and decides liability. The explanation has to clearly state the policy definition, limitation, exclusion, or condition the denial rests on. Notice that the Illinois Department of Insurance is available must come with it (50 Ill. Adm. Code 919.50(a)(1)).
The same rule bars a denial based on information from a phone call or personal interview unless that call or interview is documented in the claim file. Failing to promptly give a reasonable and accurate explanation of the policy or legal basis for a denial is also on the Insurance Code's list of improper claims practices, when done without just cause (215 ILCS 5/154.6(n)).
So read the letter for a named provision. If it says only "wear and tear" or "no storm damage," ask Allstate in writing which provision it applied and what it relied on. Keep the reply with your claim file. Our broader guide to your options after a denied roof claim ranks the remedies by cost.
Why Allstate Denies or Reduces Roof Claims, in the Policy's Own Words
Allstate publishes its House & Home Policy, form AVP81, on its state policy contracts page, and the Illinois list shows that form. Your policy may carry endorsements that change it, so treat the quotes below as a map of where to look, not a reading of your coverage.
Wear and Tear and Deterioration
Under Dwelling Protection (Coverage A), AVP81 lists excluded causes of loss that include "wear and tear, aging, marring, scratching, deterioration, inherent vice, or latent defect." A denial built on that exclusion is a claim that the damage came from age, not the storm. What answers it is evidence of cause: dated photos taken soon after the storm, impact marks documented slope by slope, and weather records for the date of loss. Our adjuster says no damage guide covers that evidence in more detail.
Wind and Hail Roof Losses Follow Their Own Payment Rule
In AVP81, the Building Structure Reimbursement provision is the one that lets you collect more than the actual cash value payment after you repair or replace within 180 days. The same provision says it "will not apply to roof surface(s) when the loss is caused by windstorm or hail." That is why a roof check can come in low on a policy that pays replacement cost on the rest of the house.
Allstate's Roof Surfaces Endorsement (form AVP84, shown here as posted by an insurance agency) pays the smallest of the repair cost, a scheduled percentage of replacement cost, or the policy limit. For a composition roof, the schedule in that copy runs 85% at age 5, 70% at age 10, 55% at age 15, 40% at age 20, and 25% at age 25 and older. The percentage applies to all roof surface components and the installation, including overhead, profit, labor, taxes, and fees. Payment under it "will not include any increased cost due to the enforcement of building codes," and the deductible applies in addition.
We could not confirm which Allstate roof endorsement, if any, is filed for Illinois, and it can differ from policy to policy. Your declarations page shows what you have. We explain the mechanics, with the Farmers version beside it, in our guide to roof payment schedules and recoverable depreciation.
Cosmetic Damage Exclusions
Allstate has used a "Metal Roof Surfaces Cosmetic Damage Exclusion Endorsement" (form AVP313) in other states. News coverage of a New Mexico lawsuit quotes it as excluding "cosmetic damage caused by hail to the surface of a metal roof, including but not limited to, indentations, dents, distortions, scratches, or marks that change the appearance of a metal roof." That quote concerns metal roof surfaces. If your policy lists that endorsement, a dents-only finding on a metal roof is a coverage question, not a documentation question.
Damage Below the Deductible
Allstate's wind and hail claims page says the adjuster makes a coverage determination and, if covered damages exceed your deductible, discusses payment options. A below-deductible finding means no payment even when damage is covered. That puts the dispute on scope and price, so a complete, line-item estimate of the roof matters more than an argument about the storm. The same page says the inspection must happen and be documented before you begin repairs you want covered.
Match the Reason on the Letter to the Next Step
| Reason on the letter | What is in dispute | Step that fits |
|---|---|---|
| Wear and tear, pre-existing damage | What caused the damage | New evidence tied to the storm date, then a written re-inspection request |
| No hail or wind damage found | What the inspection saw | Independent inspection report with photos, a request for Allstate's photos and estimate, a second look |
| Below deductible, or a low estimate | Scope and price | A written contractor estimate, then appraisal if the two numbers stay apart |
| Excluded or limited by an endorsement | What the policy language means | Read the endorsement, then a Department of Insurance complaint or an Illinois insurance attorney |
Ask Allstate for Its Estimate and Its Depreciation Worksheet
Illinois regulations give you two requests worth making in writing, with your claim number. If a partial loss was settled on a written estimate prepared by or for the company, the company has to supply a copy on request. If you then get your own written estimate showing repairs will cost more, the company must review it and respond promptly in writing, and either name a contractor who will do the repairs in a workmanlike manner or give written notice that reasonable costs above its estimate will be reimbursed (50 Ill. Adm. Code 919.80(d)(7)(C)).
On an actual cash value settlement of a residential fire and extended coverage policy, the company must, on request, provide the claim file worksheets detailing every deduction for depreciation, including the age, condition, and expected life of the property (919.80(d)(8)(A)). Our guide to reading an adjuster's estimate shows what to look for once you have it.
We can write a line-item roof estimate for you at no charge. Giving you a documented number to compare is our job. Arguing coverage or negotiating the settlement is not.
Appraisal: When It Fits and When It Doesn't
AVP81 lets either side make a written demand for appraisal if you and Allstate fail to agree on the amount of loss. Each side selects a competent and impartial appraiser and tells the other who it is within 20 days after the demand. The two appraisers pick an umpire, a written award agreed by any two sets the amount of loss, and each side pays its own appraiser and splits the umpire and other expenses.
The Illinois Department of Insurance's claims guide is blunt about the limit: appraisal determines costs, not whether the policy covers them. It fits an accepted claim with a gap in price. It is the wrong tool for a flat coverage denial.
File a Complaint With the Illinois Department of Insurance
Complaints must be in writing and can go online, by email, by mail, or by fax. A copy goes to the insurer, Illinois law allows the insurer 21 days to respond, and the Department asks you to allow four to six weeks for its investigation. The Department cannot act as your lawyer, cannot decide the value of damaged property, and cannot resolve a dispute where the only evidence is your word against the company's. It can ask for corrective action where it finds a violation of insurance law or of the policy (Department complaint process).
For context, the Department's 2025 Consumer Complaints Ratio Report lists Allstate Vehicle and Property Insurance Company with 209 homeowners complaints, 182 of them citing claims handling, against $497,305,613 of Illinois earned premium. That is 0.4203 complaints per $1 million of premium, compared with a homeowners industry mean of 0.4073. The report counts complaints received. It does not say which ones were justified, and it tells you nothing about your claim.
Watch the Suit Deadline
AVP81's Action Against Us section says no one may bring an action about the existence or amount of coverage, or the amount of loss, unless there has been full compliance with all policy terms and the action is commenced within one year after the inception of loss or damage. Your own policy's wording controls, and it may differ.
Illinois law tolls a policy's suit-limitation period from the date proof of loss is filed until the date the claim is denied in whole or in part (215 ILCS 5/143.1). When the period is tolled, the company must tell you in writing, at the time it denies, how many days were tolled and how many remain (919.80(d)(8)(C)). If your denial letter leaves that out, ask for it. Because the clock keeps running while you negotiate, have an Illinois attorney confirm the date.
Where a court finds an action or delay vexatious and unreasonable, 215 ILCS 5/155 lets it add attorney fees and a capped additional amount to the costs. Whether that fits your facts is a question for a lawyer.
What We Do, and What We Don't
C&N Construction is a roofing contractor. We inspect, photograph, measure, and write estimates. We attend adjuster re-inspections. We don't interpret your policy, argue coverage, or negotiate your settlement, because Illinois reserves that work for licensed public adjusters and attorneys. The callout below explains the free referral list, and the full carrier guide is on our Allstate roof claim page.
Other pages that help at this stage: the insurance claims process, whether a public adjuster is worth it, how long you have to file a roof insurance claim in Illinois, and the free storm damage roof inspection.

Allstate Denied or Underpaid Your Claim?
Two things, both free. First, a Haag-certified roof inspection with full photo documentation in the exact format carriers require, so any dispute starts from hard evidence. Second, our referral list of Illinois-licensed public adjusters who handle storm claims in Chicagoland, so if your claim needs a professional negotiator, you know who to call.
One line we never cross: we're roofing contractors, not public adjusters. We don't interpret your policy or negotiate your settlement, because Illinois law reserves that work for licensed public adjusters. What we do is document your damage to a forensic standard and connect you with the right licensed help. No cost, no obligation, and nothing to sign.
Full disclosure: we don't take referral fees from public adjusters, and no one on the list pays to be on it. Referrals are based on Illinois licensing and storm claim experience, and you're always free to hire any public adjuster you choose.
